This session will update council finance staff involved in fees and charges. In October 2019 the ATO released a GST Class Ruling on fees and charges and it has changed the way council need to view fees that have an element of exempt permission (permits) and use of council facilities (taxable). This session will show how you need to reevaluate the GST on these types of fees.
This affects fees for market stalls, events, use of roads (except outdoor dining), film rights, marina and boat ramp fees etc. Other aspects of the SA ruling and how the ATO ruled differently in SA to NSW will be covered and the impact this may have on NSW fees.

||Pat McCarthy is a Chartered Accountant and is the principal of Genesis Accounting based in Sydney. He is a tax consultant who has specialised in GST for local government for the last 20 years. Previously specialising in income tax with a big 4 firm he switch to GST in 1999 after winning a tender with the NSW Local Government and Shires Association to conduct GST training courses for NSW councils.
He and his team rolled out 180 days of training over the next 18 months. Fees and charges has become a favourite subject and Pat wrote most of the content for the 8 NSW council Class Rulings covering 152 NSW councils and went on to prepare ATO private rulings on fees and charges rulings for another 90 councils in Queensland, Victoria and WA.
In December 2019 he presented a paper to the annual SA Local Government Finance Managers conference on the new ATO SA GST Fees and Charges Ruling.
